American man sues Dunkin’ Donuts after “traumatic toilet explosion” | Abroad

A man from the American state of Florida is suing Dunkin’ Donuts for almost 46,000 euros. He claims a toilet at one of the international chain’s locations exploded, leaving him covered in feces and urine.

Paul Kerouac says in the court papers, which are obtained by several American media such as ‘Fox Business’, that the incident was traumatic and that he “suffered serious and long-lasting injuries”. Kerouac visited the donut giant in Winter Park, a town in Florida, on January 6, 2022, and went to the bathroom there. According to the man, the toilet exploded, leaving him covered in “debris, human feces and urine.”

Kerouac said that as a result of the toilet explosion, he “suffered physical injury and psychological harm resulting in pain and suffering, disability, permanent and significant emotional injury, mental anguish, loss of ability to enjoy life, expenses for medical care and treatment,” according to the lawsuit. “Plaintiff requires mental health care and counseling as a direct result of the trauma he experienced in the restroom of the defendant’s business and the ongoing trauma following the event.”

Negligent

Kerouac is therefore demanding damages of at least 45,8,000 euros, because the Dunkin’ Donuts franchisee is said to have been negligent. Store employees would have known about previous problems with the restroom because there had already been incidents, the complaint says. The franchisee, according to the plaintiff, had an obligation to customers to maintain the men’s restroom and restroom in “a reasonably safe condition” and to warn of known hazards or dangerous conditions. According to Kerouac, that did not happen.

Fox News and New York Post, among others, have asked the chain for a response, but Dunkin’ Donuts has not yet responded.
