The Supreme Court of Russia dismissed the complaint of a man who was deprived of a driver’s license due to the fact that he drove a car after taking Corvalol, reports “RIA News” with reference to the judgment.

According to the court, the man was stopped by the traffic police due to the fact that he did not give way to pedestrians. Checking the driver for intoxication revealed traces of phenobarbital in his blood, which is recognized as a psychotropic substance. The examination rules do not establish an acceptable concentration limit for a psychotropic substance and do not take into account the purpose of its use, so the man was deprived of a driver’s license, the agency notes. He went to court to challenge this decision.

The plaintiff explained that the drug contained a psychotropic substance, the use of which for medical purposes is legal. He also pointed out that the failure to take into account the purpose of the intake and the concentration of the substance was contrary to the right to health care and medical care enshrined in the Constitution.

However, the court did not agree with the position of the plaintiff, explaining that it is impossible to drive a car “in a state of any kind of intoxication” and dismissed the claim.
