A year ago, residents of the Hefveld in Eindhoven were startled by the explosion of an anti -tank grenade. The Woonbedrijf Foundation does not want the people who lived in the house where the explosion was there. The Court of Appeal in Den Bosch gave Woonbedrijf equal on Tuesday and believes that she wants to rightly put the residents out of their house. The court in Den Bosch previously ruled that this measure is going too far.

A completely destroyed kitchen block, a staircase that was relieved, different jumped windows and almost all the frames that were damaged. The consequences of the blow that accompanied the explosion on October 17 were huge.

Costs run in the tons
The front, back and side walls of the rental home also suffered such damage that it must all be restored. The work has not yet been completed. The contractor hopes to be able to do that next month. The costs of this renovation job and the missing of the rent are calculated by Woonbedrijf at more than 205,000 euros.

The Court does not speak out about whether those costs (wholly or partly) can be recovered from the residents. They do have to pay the costs of the proceedings. Furthermore, it is clear the conclusion in the appeal that they could have prevented the misery by not bringing a friend into the home with that anti -tank grenade.

Firing was not a plan
The weapon was forbidden and, moreover, it was fired, causing a lot of damage. The explosion arose after the man who lives in the house had shifted part of the weapon apart. He had found the weapon in the storage room of an apartment house he had emptied. Both stated that they were curious about the weapon and that they were not going to fire it that evening.

According to the court, the feeling of safety among local residents has received a strong blow because of the explosion. Woonbedrijf has rightly suggested that the residents are no longer allowed to return. For example, the neighbors no longer have to be afraid of attacking their living pleasure and the housing foundation at the same time issues the signal that this behavior is not tolerated.

Possible on blacklist
The court in Den Bosch was earlier in the hand of the couple. They are afraid that they now have to look for another social rental home outside of Eindhoven. They also take into account that Woonbedrijf will place them on the blacklist, so that they are not eligible for another rental house for the time being. The judge also took into account in his assessment that the couple behaved as a good tenant for years until the 17th of October.

The court further found that there were many questions about the weapon: how did the man who were visiting the couple were there, was there a relationship with the criminal environment and how did it go? The court in Den Bosch was much more firm in this and the living company is very right. The couple who lives in the house has called the disaster about himself.

Another legal proceedings are ongoing, but the Court does not expect that the residential company will receive zero on the Lekest, just like at the court.

‘Appropriate measures’
The men who have been busy with the anti -tank grenade may also be prosecuted. The Public Prosecution Service has not yet taken a decision. The police have already urged Mayor Jeroen Dijsselboem to take appropriate measures.
