For the defense, represented by the lawyers Giuseppe Iannaccone And Marcello BanaFerragni is innocent. The word passes to the single judge Ilio Mannucci Pacini. The outcome of the trial will depend on whether or not theaggravating contested by the prosecutor’s office. The crime of aggravated fraud can in fact be prosecuted ex officio, while to proceed with simple fraud a complaint from the offended party is required. A complaint which, in this specific case, was first presented and then withdrawn by Codacons after the compensation agreement reached out of court with the influencer. On a practical level, it means that if the judge does not recognize the aggravating circumstance of «impaired defense» of consumers, the crime of fraud will be declared extinct and Ferragni will be acquitted with a sentence not to prosecute.
