The court ruled that the signs in Pervijze were not legally valid at that time. As a result, the speed limit of 50 km/h did not apply and the maximum permitted speed was, so to speak, at 70 km/h. The defendant therefore drove 16 km/h too quickly instead of 36 km/h. As a result, the violation was considered less difficult and the punishment was limited.
