A man from Rosmalen who allegedly threw an illegal fireworks bomb at a police officer was acquitted on appeal on Monday of attempted serious assault. The 19-year-old was previously sentenced to community service, but according to the court, the camera images do not show that the man deliberately threw the nitrate at the officer.
The man was sentenced to 120 hours of community service in March last year. He also had to pay the officer, who was standing a few meters from the exploded fireworks, compensation of 250 euros.
The court finds that it cannot be established from the camera images that he deliberately threw the nitrate at the officer. The man was therefore acquitted on appeal.
The man previously told the police judge that he threw the fireworks bomb into an open space. “I didn’t see that officer or the police van,” he said. “It was a very stupid and stupid joke, under the influence of alcohol.”
Shock wave through the body
The atmosphere in Den Bosch was noisy on the night of January 6 to 7. At one point, an officer was warned by a colleague: “Be careful, fireworks are being thrown at you.”
A few seconds later, the sergeant saw something flammable land near him. He heard a huge bang and felt a shock wave through his body.
‘lucky’
When the case was previously tried, the prosecutor said the officer was lucky. “Luckily he was wearing hearing protection, so he suffered no damage, but he did start to doubt whether his job was worth it.”
Now that the man has been acquitted on appeal, the officer no longer has to count on compensation.
