On appeal, 38-year-old Abderrehim B. from Leiden was sentenced to ten years in prison for manslaughter of Jonathan Affriat in Hoogersmilde. Affriat was shot dead by B. on November 9, 2020 at the De Horrebieter campsite.
The court in Assen imposed a fifteen-year prison sentence on B. a year ago. This is the maximum sentence for manslaughter. The court then took into account that B. had already served a prison sentence for killing someone. B. relied on self-defense, also before the court in Leeuwarden. This has not been proven by the court.
The court assumes that B. Affriat did not kill in cold blood. Witnesses saw a man flee after the incident, who was apparently in a panic.
B. and Affriat know each other from prison. B. had three gold bars, a sum of 20,000 euros and a Rolex watch in custody for Affriat. Affriat wanted this back. B. later stated to the police that he had been threatened beforehand. This does not appear from the victim’s phone.
B. informs his mate that everything will be handed over, when in reality the money has been spent on paying off his debts. The money, the gold bars and the watch were also never found later.
According to B., he was suddenly threatened with a weapon by Affriat at the barrier. Both got into a struggle and B. took the gun and fired as many times as he could. Affriat had four gunshot wounds, from which he died.
The gunshot wounds do not match B’s story. The shooter could not have been under the victim, but must have been standing a short distance away. Two weeks ago, the Public Prosecution Service (OM) demanded 13 years in prison and TBS with compulsory treatment.
Previous treatments have been unsuccessful. B. apparently does not allow himself to be guided and does not seem to want to organize his life in a socially acceptable way. In this light, the court finds treatment with forced nursing inappropriate. B. must pay relatives a total of more than 40,000 euros as compensation.
