Kärkkäinen was notified of the decision of the Police Board on March 22, 2024. In his appeal to the Administrative Court, Kärkkäinen says that he was at that time on his journey, which was therefore not able to become familiar with the decision until 23 April 2024.

The Administrative Court did not consider the justification to be acceptable.

In his complaint, Kärkkäinen denied that his stream or social publications had only been advertised after April. According to the Police Board and the Helsinki Administrative Court, Kärkkäinen toured the marketing ban on him by promoting his social accounts and streams of the Potutarah web site, which still showed gambling advertising.

According to the Administrative Court, this was a so-called affiliate site aimed at directing visitors to foreign gambling sites. The marketing of the site was, in principle, against the Lotteries Act.

Kärkkäinen markets the site by dressing it in a t-shirt with it. According to the Administrative Court, the choice of clothing could not be considered neutral against the background of the matter.

Complain

In the Administrative Court, Kärkkäinen appealed to many different matters that the Administrative Court overtaken one by one.

Among other things, Kärkkäinen appealed that there was no longer a site called Pottuora. According to the Administrative Court, this was not correct.

This web address still exists, even though the site has been transformed into another affiliate site.

The fact that the decaying stream denied that he owned or managed the site of his name was irrelevant to the resolution. According to the Administrative Court, Kärkkäinen has been promoting the site continuously and actively. At least it was about close cooperation and partnership marketing.

Kärkkäinen also claimed that his gambling marketing did not target Finland and appealed to a large number of expatriate Finns. The Administrative Court disagreed.

The penalty payment of EUR 25,000 will remain in effect. In addition, he has to bear his own costs in the administrative court. The decision may be appealed to the Supreme Administrative Court.
