More and more people order their goods online. There are increasingly false or defective delivery. Consumers should therefore know their rights and the right steps in order to be able to react appropriately.

Legal claim

According to a contribution by lawyers Kotz GbR, consumers have a legal right to subsequent performance. Buyers are therefore entitled to receive the correct goods or to receive the purchase price, since the seller bears the transport risk until the customer is delivered and is therefore responsible for the proper shipping of the goods. However, the seller has the right to reclaim the incorrectly delivered goods, even if the buyer wants to keep them.

Evidence

In order to be prepared in the event of false delivery, the package should be weighed before opening. If the weight and size of the package do not match the expected product, an incorrect delivery can be assumed. Then even evidence should be created in the form of photos or videos during the opening in order to be able to argue in the event of a dispute. If a false delivery has been determined, the seller or dealer should be informed immediately. At best, the evidence created are provided directly. The same applies to damaged goods, although the condition of the package should also be documented.

Return

As a rule, the seller requires a return of the wrong goods before a reimbursement or another broadcast takes place. It is important that the seller should cover the costs of the return. In principle, the dealer should be set a period to accelerate the process and set a time frame. If the seller is not ready for an agreement, there is the possibility of an advertisement. In case of doubt, advice should always be obtained.
