7 months in juvenile detention for son (21) who killed drunk father | Inland

A psychologist and the probation service had advised juvenile criminal law. The son suffers from PTSD, has reduced responsibility and is not yet very mature, according to the experts. The son was 20 years old at the time of the fatal stabbing. The Public Prosecution Service demanded two years of juvenile detention, the maximum duration. The judge believes that the boy should also be treated and therefore imposes a lower prison sentence.

Under his pillow

The son stabbed his father (46) in the hall behind the front door on the evening of Sunday 20 June 2021. The father was under the influence of alcohol after a restaurant visit with the mother. The son had been on drugs that day. The couple had been in a difficult relationship for years. This was accompanied by domestic violence, also towards the son.

The son admitted the stabbing. According to him and the mother, there was an argument because the father played loud music in the backyard at night. The son took the sound system. In the pantry, he was beaten by his father. The 21-year-old pushed his father over and then took a knife from his bedroom. The son collected stabbing weapons and slept with two of them under his pillow.

The son’s lawyer is of the opinion that the act was based on a panic reaction, and then it concerns severe weather. The judge disagrees. By consciously taking a knife, looking for the threatening situation downstairs again and stabbing directly, the son has exceeded the limits of the necessary defense, according to the judge. The son has said little about his thoughts during the stabbing.

The judge imposed, among other things, probation supervision and outpatient treatment as conditions. The son must also live in assisted living, at least during the probationary period of two years. The judge is not confident enough that the son will receive proper support if he goes back to live with his mother.
