trans law | Two Senate corrections will delay the entry into force of the trans law for at least a couple of weeks

The LGTBI collective will have to wait at least two more weeks to celebrate the approval of the trans law: two technical corrections by the Senate force the text to be returned to the Congress of Deputies for final approval, which will imply a delay of at least 15 days.

The Equality Commission of the Upper House has endorsed this Wednesday the report of the presentation (17 votes in favor and 12 against) of the bill for the real and effective equality of trans people and for the guarantee of the rights of LGTBI people. The text is practically identical to the one approved by Congress, except for two technical modifications that do not change the meaning of the norm.

It is about the replacement of a word by another similar one and the deletion of a mention of intragender violencean issue that Congress decided to withdraw from the norm, reports Efe.

It is the second time in a short time that an Equality project has to delay its entry into force due to a minimal change in the Senate: it already happened to the law of only yes is yes last summer.

ERC senator Elisenda Roca has specified to El Periódico de España, from the Prensa Ibérica group, that in this case there have been two modification proposals that have become compromise amendments (and unanimously supported) to give coherence to the text.

Specific, it has been decided to replace the term “procedure” by “process” in the fifth final provision and for eliminating the reference to intra-gender violence in the sixteenth final provision, since it does not make any sense after Congress had deleted this issue from the whole norm.

With these technical modifications turned into amendments, the text will necessarily have to return to Congress. As it will be next week when the Plenary of the Senate gives its approval, the final approval in the Lower House cannot be before two weeks.

Next week, in the plenary session of the Senate, the amendments that the different groups choose to keep alive will be voted on. They have submitted a total of 249 proposals. The PSOE, after a complex and controversial procedure in Congress, considered the matter closed and ruled out registering new amendments in the Senate.

The trans and LGTBI law, one of the flagship projects of the Ministry of Equalitywill allow gender self-determination from the age of 16, that is, that any person may request the change of sex in the Civil Registry with no other requirements than their own will. Minors aged 14 and 15 may also do so, but with the authorization of their parents or legal guardians.

Self-determination of gender will mean that a person can change their name and sex in the Civil Registry simply by expressing their will. Thus, Spain will stop considering trans people sick (depathologization of transsexuality) and will end the medical and judicial protections that were imposed on them up to now.
