Theater renovation in Den Bosch can continue: neighbors get the shortest end

The municipality of Den Bosch has rightly given permission for the demolition and new construction of the Theater aan de Parade. The Council of State determined this on Wednesday. The work therefore does not have to be stopped.

A number of local residents and nuns from a neighboring monastery had gone to the highest court in our country, because they think, among other things, that the new theater is becoming too big. They are also afraid that a ventilation system will cause odor nuisance and air pollution. The Council of State brushed off all their arguments.

Sigh of relief
The verdict will lead to a sigh of relief at the Bossche town hall. The municipality has been committed to a new Theater aan de Parade for about fifteen years now; it is a hard blow for the plaintiffs. Earlier this year, they seized the last straw with the Council of State to voice their objections. Jos Wagenaars, one of the objectors, said beforehand that they had little chance. His fear has come true.

Last February it became clear that the demolition of the Theater aan de Parade could finally start. The million-dollar job had already been delayed by a number of legal proceedings. During the demolition and renovation of the theater complex, there was still a case that local residents had brought against the city council. This has now been judged.

‘Stink and noise in the garden’
The local residents especially think that the new theater is becoming too big. They also say that dirty air that is blown from the new building ends up in the garden of some neighbors with a lot of noise. “If a thousand people are having a carnival in the theater, all that stench and noise will come into our garden,” another objector, Frans Carpay, said earlier this year during the session at the Council of State.

That would rule at the end of February or the beginning of March; finally that happened on Wednesday morning. Nothing will change for the municipality and the contractor. The demolition and renovation were legally valid and therefore do not have to be stopped. The local residents will have to accept this. The parties involved will provide a response later this Wednesday.

The performances programmed for the Theater aan de Parade have been performed in the Brabanthallen since October. More than a hundred program components take place here per season. Theater director Alex Kühne expressed the hope last autumn that the new theater can be taken into use in the summer of 2023.
