In the demands for unconstitutionality of the autonomous communities, it is alleged that the challenged law could be contrary to the regime of distribution of autonomous powers in matters of territorial planning, urban planning and housing.

The plenary session of the Constitutional Court will review the housing law approved by Congress just before the last elections on July 23 by admitting to processing the unconstitutionality appeals presented by 50 deputies of the Popular Parliamentary Group in Congress, the Parliament and the governments of Andalusia, the Balearic Islands and Madrid.

The 11 magistrates have accepted for processing all the appeals presented against various provisions of Law 12/2023, of May 24, for the right to housing, which capped the increase in rents. The appellants challenged, among other articles of the norm, 8 a, 15.1, 16, as well as several sections of articles 18, 19 and 27 and the third additional provision, the first transitional provision and the first final provision.

In the unconstitutionality lawsuits of the autonomous communities, it is alleged that the The appealed law could be contrary to the regime of distribution of autonomous powers in matters of territorial planning, urban planning and housing.

The unconstitutionality appeal of the Popular Parliamentary Group also raises the possible violation of the right to property, the right to effective judicial protection and local autonomy.
