The municipality of Tynaarlo may not terminate an employee’s employment contract

According to the judge, the municipality’s criticism of the experience, competencies, work and behavior of the professional manager is not justified. The woman’s former managers describe her as an excellent, constructive and connecting manager. And are positive about her efforts and skills.

The woman has properly substantiated her position within the municipality of Tynaarlo, the judge finds. She meets the expectations as formulated in the vacancy text. According to the judge, the municipality has not made it plausible that she has increased the unrest among her employees.

In response, the employee asked that the municipality be sentenced to rehabilitation. That request was rejected. She only did this at the hearing. A late date, the judge believes, and also insufficiently substantiated.
