The EU is investigating X

This is the first official infringement procedure that the Commission will initiate under the new digital services act.

The European Commission announces that it is investigating whether messaging service X has violated the provisions of the EU Digital Services Act. Potential violations relate to regulations regarding risk management, content moderation, dark patterns, advertising transparency, and researchers’ access to information.

The Commission has conducted preliminary investigations, based on which it has decided to initiate official infringement proceedings against messaging service X. Preliminary investigations have been carried out on the basis of, among other things, the documents provided by X and the answers to the request for information regarding content related to terrorist acts by Hamas.

Once the official infringement procedure has been started, the commission continues to gather evidence, for example by making requests for information and conducting interviews.

According to the commission’s press release, no deadline has been set for the completion of the investigation, but the duration of the investigation depends, among other things, on the complexity of the case and the company’s desire to cooperate with the commission.

This is the first official infringement procedure that the Commission will launch under the new digital services act. The digital services act aims to regulate the activities of online giants such as X, Facebook and Tiktok.
