The former professor of the Faculty of Communication of the Ramon Llull University Xavier Sastre (URL), accused of sexually harassing to three students, has filed a lawsuit against the Fundació Blanquera, which manages the center, for his disciplinary dismissal, considering that it has violated their right to the presumption of innocence and that defenselessness has occurred in the internal promise that his departure entailed. The former teacher “absolutely” denies that the protocol established from the same university concluded with “all the guarantees& rdquor; and he remarks that he did not have a “legitimate or dignified” defense & rdquor; before the commission of inquiry. He also points out that from the URL he was summoned on a single occasion, a few hours in advance, and they demanded that he answer “immediately a list of questions without knowing the content of the complaints & rdquor ;.
Sastre, who claims the nullity of the dismissal, also stresses that in the burofax of his dismissal “there is no fault that makes any reference to alleged sexual harassment” and points out that the reasons for his dismissal “do not coincide” with those that the Ramón Llull University has specified in the statements delivered to the media.
Reasons for dismissal
The Blanquerna Foundation, for its part, justifies the dismissal accusing the teacher of inappropriate behavior, serious lack of respect and mistreatment against several members of the educational community of the center. The reasons for the dismissal range from contacting students through social networks and taking advantage of the information from the networks to humiliate classmates in class, to address students with nicknames such as “precious & rdquor; or “baby”, as well as proposing to make a recording of the inside of the drawers of the students’ rooms, explaining that the “academic” objectives of the exercise were to “get to know each other better”. He even told the students, according to the teaching center: “Now I am going to get drunk and you will receive an email at three o’clock in the morning with a personalized comment from me.”

The management also accuses Sastre of “seriously harm the image of the institution in its function as a university educational center & rdquor;. At the same time, it accepts the Second Collective and Labor Agreement of the foundation, which stipulates as “very serious offenses & rdquor; the teacher’s conduct, for which reason he proceeds to exercise the sanction defined in the same agreement, dismissing him for disciplinary reasons.
The professor claims to be suffering publicly and private the consequences of the accusations of the University in the media and of the “interested leaks of the university collective& rdquor ;. He also rejects that he was suspended from salary and work for three months in the last quarter of 2022. In his place, he assures, he took a leave from work “for personal and emotional reasons” linked, among other circumstances, to the trauma of having suffered a series of unfounded accusations against him” at the beginning of the 2022-2023 academic year.
