Termination of rental agreement: These special reasons for termination exist for tenants

There are certain special reasons for termination, for which special periods of notice apply. This can be particularly interesting for temporary rental contracts or a clause excluding termination. Tenants may have the right to special termination in the following cases:

In the event of a rent increase, you can terminate the contract extraordinarily at the end of the month after next. You may make use of this special right of termination within two months of becoming aware of it. If you do that, the rent increase won’t apply to you until you move out. If a landlord refuses to sublet without good reason, this also results in a special reason for termination for the tenant. The notice period is then the usual three months until you move out.

If a landlord has a major refurbishment announces, you can also terminate the contract extraordinarily at the end of the month after next. This termination must be submitted to the landlord by the end of the month following receipt of the modernization notice. For example, if you are informed about a comprehensive renovation in mid-March, you can send a letter of termination throughout April to withdraw from the rental agreement at the end of June.

In case of a health hazardfor example due to mold or damage to the building, you can cancel immediately without notice.

through the death of a tenant there is also a special reason for termination for the surviving dependents. If there are several main tenants, for example if both spouses are in the tenancy agreement, the widower or widow can give notice of termination within one month to the normal statutory period of three months. If there is only one of the two main tenants in a married couple, the tenancy is transferred to the living partner. They can also terminate the rental contract within one month at the usual three-month period.
