Solar panel company has 9 tons of debt, mismanagement investigation

The directors of the bankrupt solar panel company Sustainability Center Netherlands from Terheijden may have been guilty of mismanagement. The curator is investigating this because there are indications. This means that the directors may ultimately be held personally liable. There are fifty creditors who together have more than 9 tons in credit.

After the court in Breda declared the solar panel company bankrupt last month, curator Fred Froger looked at the administration of the Sustainability Center of the Netherlands.

For the time being, this shows that fifty people, companies and the tax authorities still receive money from the company: a total of more than 9 tons.

  • The tax authorities are the largest creditor with around 348,000 euros.
  • Since 2020, the solar panel company has not paid payroll taxes and sales tax.
  • The bankrupt company owes about 558,000 euros to the other 50 creditors.

Among them are dozens of people who reported to Omroep Brabant in January. They made down payments of many thousands of euros to make their houses more sustainable. However, the company did not supply solar panels. Directors André Troost and Wilco Beljaars were also very difficult to reach. One of the creditors then filed for bankruptcy. The company had been making losses for a long time.

No valuables
According to the trustee, no items of value were found in the business premises. There is also no money in the accounts.

In the course of time, directors Troost and Beljaars have transferred 300,000 euros to themselves and to their associated companies. Curator Froger has asked them several times to repay this money. But they didn’t. Troost and Beljaars have not yet transferred all the administration, which was also asked several times. “That’s remarkable,” Froger said.

personally liable
Partly for this reason, he is conducting formal investigations into ‘improper management’ and ‘possible act of fraud’. The latter means that in the face of bankruptcy, entrepreneurs wrongly favor creditors when returning money. This is not allowed by law.

If this is the case, the directors can be held personally liable for the tons of debt. The chance that private individuals will see something of this is also small. They are at the back of the line of creditors.

‘No scams’
Earlier, director Troost told Omroep Brabant that he and his campaign have not defrauded people. He did say that more money went out than came in. Both are unavailable for further explanation.
