Yes, why, Draghi extended until 30 June 2022 the simplified emergency regime for fragile workers which allows you to use agile work according to a simplified path compared to the ordinary legislation contained in the law n. 81/2017: “Measures for the protection of non-entrepreneurial self-employment and measures aimed at encouraging flexible articulation in the times and places of subordinate work “.

And so what will not change with regard to agile work until next June 30th? Let’s see in detail. Meanwhile, employers will still have access unilaterally and with simplified formscarrying out work remotely, therefore without the need to sign written agreements with each worker.

Then, the administrative communications to the portal of the Ministry of Labor for the activation of agile work will still be done in a simplified manner, therefore simply the list of smart working personnelaccompanied by a few simple information.

Finally, until June 30, union agreements will not be necessarybut only optional and will bind companies only if they apply a CCNL, national collective labor agreement or a second level agreement that governs agile work (as required by Protocol signed by the Ministry of Labor and the social partners on 7 December last).

There rule affects public and private employeesthat must get a certificate certifying the risk condition (deriving from immunosuppression, oncological pathologies, carrying out life-saving therapies) or serious disability (pursuant to law no. 104/1992).

Smart Working, is the return to normality postponed?

The return to complete normality is therefore postponed to July 1st. However, this postponement should not be thought of as a slowdown in the return to normal. In fact, pur maintaining the simplified regime for a few more months, in the meantime, companies can organize themselves to overcome the emergency phase of agile work, building new organizational models based on different principles.

It is therefore able to enhance alternation and objectives as new levers to increase productivity. It would be a shame to turn this one extension in an excuse to continue leaving people at home without a specific organizational plan.
