A 41-year-old man from Oss has been sentenced to two years in prison. He shot another man in the leg a year ago. The two had an argument with each other. The perpetrator thought it was self-defense. According to the court, it was attempted manslaughter.
Almost a year ago, the perpetrator was in a house in Oss with his girlfriend, sister and mother. The victim and his son also came there. They got into an argument in front of the house and a fight broke out.
The perpetrator grabbed a firearm and shot the man in the thigh. He then also shot at the victim’s van. He then drove to the doctor’s office in that van with bullet holes.
The perpetrator admitted to the judge that he shot the gun and also said that he did not know that the gun was loaded. His intention was to scare the man with whom he was arguing with the weapon.
Self defense
According to his lawyer, there was no attempted manslaughter. The man is said to have deliberately aimed at the ground. According to the lawyer, there was also self-defense, because his client was attacked.
The court did not agree with this and ruled that there was indeed an attempted manslaughter. This way the shooter knew that there were bullets in the firearm and that there was no safety catch. He also pointed the firearm at the victim, who was standing nearby.
The court ruled that the perpetrator indeed had to defend himself, but called it disproportionate by shooting an unarmed opponent with a firearm.
When determining the sentence, the situation in which the court ruled that the perpetrator was allowed to defend himself and that there was a conflict between the perpetrator and the victim was taken into account.
In addition to the two-year prison sentence, the suspect must also pay compensation of 5,520 euros to the victim.
