Saxon consumer advice center is calling for a class action lawsuit against Zalando

The Saxon consumer advice center is planning a class action lawsuit against Zalando.

The reason for the planned lawsuit are reminder fees demanded by the Berlin online retailer. Customers who order from Zalando and do not pay within the set deadline will receive a reminder fee of 5.30 euros with the second reminder by email. However, this is illegal, according to the Saxon consumer advice center.

The planned class action lawsuit would enable customers to reclaim the reminder fees they have already paid, because most would pay these numbers and “trust that one of Europe’s largest mail order companies adheres to applicable law,” according to the statement.

Are the fees not permitted?

“We consider these fees to be inadmissible,” says Michael Hummel, legal expert at the Saxony Consumer Center. “On the one hand, there are no regulations in Zalando’s general terms and conditions, and on the other hand, according to case law, only costs actually incurred can be claimed. And these are negligible when it comes to email reminders.”

Class action lawsuits have only recently been introduced as an instrument for consumer protection and this is exactly what the consumer advice center is now taking advantage of. Those affected who received a corresponding claim by email before October 13th can join the class action lawsuit using an online form. All you have to do is prove that the fees have been claimed and paid.

In a further step, after the lawsuit has been filed, anyone interested can join. There are no costs involved, as the Saxony consumer advice center covers them.
