According to the judge, B. and T. were involved in an attempted manslaughter during fights earlier that evening. He noted that before the violent incident with Carlo, the Hilversum men had already committed ‘extreme violence’ in two other cafes.
In addition to the three main suspects, six more men were on trial in the Mallorca case. For the majority of the group, the judge issues unconditional prison sentences. Sanil B., who played a central role in all incidents, receives the highest sentence: seven years in prison, minus pre-trial detention.
Big question
It is striking that the judge does not agree with the demand of the Public Prosecution Service (eight years in prison) for Hein B. and Mees T. regarding the death of Carlo. The judge does not consider it proven that they were involved in the fight with him, but they did play a role in other incidents that evening. As a result, they receive a light prison sentence. Other boys from the group of friends are punished more severely than the requirement of the Public Prosecution Service due to their role in those other fights.
The big question that hung over the Mallorca case was whether the court could find enough evidence to hold at least one of the suspects responsible for Heuvelman’s death. The 27-year-old man in Waddinxveen was so abused on the night of July 13 to 14, 2021, that he died of his injuries four days later.
Nine boys from Hilversum, ranging in age from 17 to 19 at the time, stood trial for the violence. They were involved in other videotaped incidents of violence that evening and appeared in sixty witness statements.
No reminder
The brawl in which Heuvelman was involved is not on camera. That made the trial over who was guilty of his death complex, all the more so because witness statements were inconsistent or contradictory and were contradicted by the main characters. None of the suspects said they remember what happened to Heuvelman.
Especially B.’s role in the murder was an important part of the process. Heuvelman’s DNA was found on his shoe, but so small that it was questionable what the court could conclude from it. The judge considers it proven that B. handed out the shovel, also because the profile from a witness statement points to him and he acted ‘worked up and aggressive’ throughout the evening.
It was predetermined that the judge would sentence some boys from the group of friends on Friday: brutal violence in other fights was recorded on film and was not denied.
