Rubiales Case | The Government does not give up on Rubiales: it will ask the TAD to temporarily suspend him

The Minister of Culture and Sport, Miquel Iceta, has appeared this Friday urgently to announce that the Government is going to request the Administrative Court of Sports (TAD) to temporarily suspend Luis Rubiales to hold positions in sports entities, in application of article 102.d of the Sports Law. A movement that occurs after the TAD itself has described as “serious” and not “very serious” the actions of the suspended president of the RFEF denounced by the Higher Sports Council.

The TAD ruling known this Friday has been a severe setback for a Government that practically took it for granted that the court would agree with it and that the CSD could proceed to the suspension of Rubiales in the next 48 hours. As they are not classified as “very serious” offenses, the Government cannot activate this mechanism.

The TAD has the floor again

The reaction of the Government, by means of “a document that we are going to present immediately”, is to request this precautionary measure. Now the ball returns to the court of the TAD, which will have to study whether or not to execute this precautionary suspension.

“Likewise, the Higher Sports Council is studying the possibility of appeal in contentious-administrative proceedings the decision that the Administrative Court of Sport has communicated this Friday”, the Iceta ministry reported later through a statement.

“It’s over”, Iceta insisted, quoting the words of Aitana Bonmatí at the UEFA gala in which she was named the best player in Europe: “We cannot allow situations of abuse of power”.

The minister has stressed that Rubiales is already is suspended for 90 days by FIFATherefore, his effective return to the presidency of the RFEF is not a possibility at this time. He has also pointed out that the Government is in contact with FIFA.
