Rocío Carrasco will sit in the dock for the accused tomorrow June 28 in Madrid. Her alleged crime, family abandonment, for not paying her son’s pension david flores, since a sentence forced him to do so, more than five years ago. The first complaint was made by her ex-husband, Anthony David Flores; the second, the injured party, his son David.

The plan is for the trial against Rocío Carrasco to begin on Wednesday at half past nine in courtroom number 11 of the Criminal Courts of Madrid. The prosecutor and the private prosecution -exercised by the latter his son, David Flores– ask that the woman be sentenced to one year in jail and to pay a fine of between 15,000 and 19,000 euros for an alleged crime of abandonment of family

The witnesses

In addition to the defendant, who may testify at the beginning or at the end of the oral hearing, David Flores is cited, as aggrieved. His sister is expected to testify as witnesses Rocio Floreshis father Anthony David Flores and his ex-partner Olga Moreno. Rocío Carrasco’s lawyer, Javier Vasallohas asked that his partner of many years be included as a witness, Fidel Albiac.

Rocío Carrasco did not pay a single monthly payment of 200 euros to which she was obliged to financially help her son, of whom the sentence spoke that, due to his disability, he was “economically dependent”.

Since coming of age, David Flores, now 22, has lived with his father, Antonio David. Carrasco’s defense will try to prove that the father took the son from home when he was still a minor and registered in Malaga without his permission. He will ask for acquittal

First chapter

This trial against Rocío Carrasco will be the first chapter of the legal battle between her and her ex-husband, for pension payments to their children since they separated. The second is scheduled for on July 6 and this time Rocío Carrasco exercises the accusation. The Prosecutor’s Office asks for Antonio David Flores four years of prison for a crime of insolvency punishable. Rocío Carrasco denounced him for not paying the pension of her two children, who were minors at the time and lived with her.

According to the accusation, Antonio David did not pay and also carried out illegal maneuvers to hide that he had money to fulfill his obligation. His ex-wife demands, in that trial, also a compensation of 80,000 euros; 60,000 euros of the debt for not paying their children’s pensions, plus another 20,000 euros for “interest, damages and expenses”.
