The new owner of camping Sandevoerde in Zandvoort has wrongly canceled the rental contracts with the regular holidaymakers. The 120 holidaymakers with a mobile home therefore do not have to vacate their permanent spot on the campsite. That has just been determined by the cantonal judge in Haarlem.
The operator, Kennemer Park, terminated the lease in November 2020. The regular campers were then told to vacate their sites in March next year. The operator wants to build 250 luxury chalets on the site.
Permit
Kennemer Park presented plans that would show that no building permit was required for the holiday homes. The operator argued that the houses would be lower than four meters and that no deeper than 40 centimeters would be dug for the foundations.
The holidaymakers argued in a previous court case that permits are indeed required and that the cancellation of the rent was not legally valid. They were also proved right by the subdistrict court judge, after which Kennemer Park made a second attempt to cancel the lease. The second termination is also not legally valid, the judge now says.
The municipality of Zandvoort also seems to be of the opinion that permits are required. Preparatory work by Kennemer Park was previously halted by order of the municipality.
