Today the government will present a provisional position on the use of generative AI (AI that creates content itself) by government organizations. The government has opted for a value-driven and responsible use of AI. The use of generative AI is therefore permitted, if it complies with applicable laws and regulations. To check this, a risk analysis must be carried out on a case-by-case basis.
State Secretary for Digitalization Alexandra van Huffelen: “The fact that a government asks its own agencies to comply with the law is actually not news. AI, and certainly generative AI, is a technology that is rapidly developing. That is why we say for the time being, carry out risk analyses, obey the law and be careful. We also keep a finger on the pulse and keep a close eye on all developments. If we gain new insights in the future, we will of course come up with a new position.”
National organizations and departments
For this position, a quick scan was carried out into the impact of generative AI. The internal guidelines of the European Commission were examined and advice was obtained from the State Attorney and the Dutch Data Protection Authority (AP). This preliminary position is in favor of the use of generative AI in departments and government organizations. The government will still enter into discussions with municipalities and other local authorities to take a government-wide position. The provisional position also applies when an external party provides services or products to a government organization and uses generative AI. Furthermore, the provisional position applies to the experimental use of generative AI, for example in pilots or testing grounds.
Generative AI
Generative AI is a form of artificial intelligence that can create text, audio, images, computer code and videos. While task-specific AI is limited to analyzing available data, generative AI focuses on creating something new based on already available data. In addition, the quality of this is already difficult to distinguish from human-made content. One of the most recognizable applications of generative AI for the general public are AI chatbots, such as Chat GPT from OpenAI.
