The news of 2022
The big news of the year is that the mandatory paternity leave for private employees it becomes structural. This means that it does not have to be renewed from year to year. The days of absence from work granted are 10.
It can also be used in a non-consecutive manner, in the first 5 months after the birth of the child or from the entry into the family of the child in the case of adoption or foster care. P.For those who become parents of twins, the days of leave provided remain the same.
Salary for this period of time it is 100% covered by INPS. And the absence will not even affect the pension, save, thanks to the figurative contribution.
Generally the allowance is paid by the employer, which advances to the worker the payment of the indemnity by the National Institute of Social Security. In some cases, however, the INPS directly pays the allowance to the working father.
Paternity leave: does not exclude maternity leave
Mandatory paternity leave it is a right that is added to that of the mother. It is autonomous and is up to regardless of what is up to the mother. The new dad, to be able to use it, you just have to notify your employer in writing with at least 15 days’ notice, indicating the period chosen for use.
It will then be the employer to communicate to INPS the days of leave taken by the worker. The application, on the other hand, must be submitted directly to INPS electronically by the working father.

The benefit was established by the Fornero law for the reform of the labor market. Initially, the duration was 2 days. Then 4 days passed for 2018. Then 5 days for 2019, 7 days for 2020. The last increase to 10 days was made for 2021 and then transformed them into structural ones from 2022.
What about optional paternity leave?
It is about an additional working day to be used on an optional basis and this too has been made structural since 2022. However, to difference in compulsory leave it is not an autonomous right, but is conditioned by the choice of the worker not to use one of her maternity leave days.
In the application, the father must in fact attach a declaration from the mother of non-use of one day of maternity leave due to her.
