THEParental leave is a right of working parents during the first 12 years of the child’s life. The “standard” one is equal to 30% of the average daily wage while from last year for the first month it is equal to 80% of the salary (up to the child’s six years of age or from the entry of the minor into the family).
But there are important innovations foreseen by the Budget law. And that is an increase in the allowance for the second month of parental leave, which goes from 30% to 60% of the salary. And, for the year 2024 alone, an increase at 80% for this second month.
Parental leave, two months in 2024 with 80% of salary
This is clarified by an INPS circular on the main provisions regarding social safety nets. Specifying that the new measure applies to employees who end the period of maternity or, alternatively, paternity leave after 31 December 2023. Parental leave periods can also be used by parents at the same time and are also valid in the case of adoption or foster care.
The percentages of the allowance are calculated on the average daily wage based on the salary of the month preceding the start of the leave period. Parental leave can be enjoyed up to the child’s 12 years of age (or from entry into the family in the case of adoption or foster care) and for a maximum overall period (mother and/or father) of nine months.
The right to abstain from work applies to the working mother after the mandatory maternity leave period of 5 months. To the working father, from the birth of his child, for a continuous or fractional period not exceeding six months, which can be increased to seven. For a continuous or fractional period not exceeding eleven months if a parent has sole custody of the child.
It is interesting to note that the planned 9 month compensation at 80% was initially a measure aimed only at mothers. Today it applies to both.
