This new right will affect all healed people who they have not relapsed for five years before the date of signing the contract.

The law, which already exists in some countries, aligns with the European strategy in the fight against cancer, which recommends member states to implement measures to avoid discrimination of survivors to this disease before 2025.

An unjust obligation that creates discrimination

Today, in fact, to request many services, such as taking out insurance and obtaining mortgages, even if you have already recovered, it is necessary to declare that you have had cancer, which is often leads to waste or increased rewards. An injustice that creates serious discrimination against those who have suffered from these serious pathologies.

In other countries, oncological oblivion is already a reality and also a bill has been presented in Italy to introduce it.

What is oncological oblivion

It is the right of a patient who has recovered from cancer not to provide information about his illness. Indeed, there are circumstances in which this information is strictly requested: in a job interview, when signing a loan or insurance contract. Having been ill with cancer often translates into an additional for the sufferer full of economic, social but also psychological suffering.

Some countries have already included this right in their legal systems. France, Luxembourg, Belgium, Holland, Portugal and Romania have already enacted a law to protect citizens recovered from cancer.

In these countries, banks and insurance companies cannot ask for information on the previous pathologies of their customers, provided that a certain amount of time has passed since recovery.

Where are we in Italy?

A bill to this effect has been filed in the Senate and although it has not lapsed, it is not currently scheduled by the justice commission.

The text calls for «the right of people who have been affected by oncological pathology not to suffer discrimination in accessing the adoption of minors and banking and insurance services” when ten years have passed without recurrences”.
