Questions after new police report

The case was already on the agenda of the subdistrict court judge last July, but the case was then withdrawn. Doubts arose as to whether it was ‘just’ a violation. An extensive additional police report on the circumstances of the accident raised a number of questions.

The case was considered too complex for the subdistrict court judge, who could not refer it to the multi-judge chamber. The Public Prosecution Service (OM) withdrew the case and submitted it, with an amended indictment, to the multi-judge chamber (with three judges).

If the Public Prosecution Service had not done this, the surviving relatives could file a complaint with the court. And the substantive hearing of the case had to wait even longer. But it didn’t come to that.
