OM demands years of imprisonment for stubborn stalker from Emmen

The Public Prosecution Service (OM) is demanding a prison sentence of twelve months against a stubborn 40-year-old stalker from Emmen. The Public Prosecution Service is strongly committed to preventing the victim from being harassed again. The Public Prosecution Service therefore also demands a restraining order against the victim, including a location ban, with one month’s imprisonment for each offense (with a maximum of six months).

The Emmenaar would also have to serve a suspended sentence of two months because he committed an error during the probationary period.

The man was convicted in August 2021 of stalking a woman from Nieuw-Dordrecht for a long time. In addition to a suspended prison sentence, he received a restraining order and had to undergo treatment. “You had received a very clear order from the court and that is that you were not allowed to contact the victim,” said the public prosecutor.

The man had become convinced a few years ago that he would have had a relationship with the victim and wanted contact anyway. The man approached her through all kinds of social media. He also called regularly. The woman also received texts and calls from US phone numbers. If she didn’t answer, the man left her voicemail. ‘I’m gonna kill you‘ was one of the messages she received.

Only after several reports, stop conversations, a restraining order and a conviction in August last year in which forced treatment was imposed, did the stalker stop. During his treatment, the suspect received his own telephone in February. After a while things went wrong and the man approached the victim again. She filed a report because the suspect would approach her on social media.

The man, who suffers from borderline and a delusional and autistic disorder, says that he once viewed her profile on LinkedIn and liked a post on Twitter. For the rest, he points to an angry ex-girlfriend who would like to set him up. “Because of the intensive treatment I have had, I have become very aware of what I have done to her. I feel a lot of shame.”

The victim doesn’t believe that. She hopes that her stalker will be ‘handled’, according to her statement. “I had hoped you would have scratched your head after the first time. You knew how to deceive things well. You got the internet and there you were again. Even when you had a girlfriend again, you didn’t know how to leave me alone. I’m in a small world again and I have to look back all the time. I don’t get to know new people. I’m surprised that you were declared impaired and received such a soft punishment. “

“I find this very hateful,” said the suspect. In the meantime, the probation service recommends compulsory admission to the Forensic Psychiatric Clinic, where the risk of recurrence could be better managed. An expert even advises a TBS measure if the suspect refuses this.

The court will rule in two weeks.
