Nicole takes Eigen Haard to court to quickly enforce a new bathroom in the home

Nicole van Klaveren from Uithoorn is filing summary proceedings against the Eigen Haard housing corporation in the hope of quickly enforcing a bathroom in her new rental home. The housing association removed it shortly after the key handover due to undetected damage, but the installation of a new one takes so long that Nicole is now taking legal action. “Too bad we can’t fight it out at their office.”

Eigen Haard promises to always deliver rental homes free of leakage and with intact tiling, sealant and floors. Soon after Nicole and her family moved into their new home, it turned out that dozens of tiles in the bathroom were broken, something they hadn’t noticed during the viewing.

At that moment there is no problem, because Eigen Haard promises to replace the bathroom. The housing corporation has a contractor emptied the bathroom, but he does it so violently that damage is not only caused in the bathroom, but also in adjacent rooms.

Meanwhile, the high tempers have considerably delayed the arrival of a new bathroom. To prevent more damage, Nicole insists on being present when the contractor installs the new bathroom. The contractor, on the other hand, only wants to work when Nicole and her family are out, because they ‘would make the work impossible for him’.

Surprise

Last Wednesday, things still seem to have taken a positive turn, but Nicole is surprised that Eigen Haard is sending the same tiler again, and the tiler shows his dissatisfaction with the fact that Nicole is home after all. “While I had let my lawyer know a day earlier that I would be there.”

According to Nicole, the tiler couldn’t have done much. “They put the tiles and glue in my garden a week ago, but the packaging says that the glue must not be left in the sun and the tiles must not get wet. And last week it was warm and it rained hard. “

“I saw the water running between the baseboards”

When the contractor lifts the wet packages inside, water drips onto the floor, creating a puddle on her brand-new laminate. “I could already see the water running between the skirting boards,” says Nicole. When she points this out to the contractor, she gets an indifferent response. “So I got down on my knees and cleaned up the water.”

left again

This in turn causes so much irritation for the tiler that he stops his work for the umpteenth time, and leaves with the project leader in his wake. “The project leader came back to apologize and said he was going to find a solution and call back, but I still haven’t heard back.”

Nicole does not yet know when the summary proceedings will be filed. “My lawyer is now preparing a subpoena.” She does not know whether Eigen Haard is already aware. “But I’ve said several times that I’ll take that step if they default.”

Spokesperson Wim de Waard informs NH Nieuws that he is aware of the legal action and that he finds the situation ‘very annoying’, but that ‘everything has been tried’ to resolve the issue with the tenants. “Then only summary proceedings.”

He confirms that the tiler left business for the umpteenth time last Wednesday, because – according to Eigen Haard – the residents would have made his work impossible again.

Complaints

“They would only be at home to let people in and then not anymore”, De Waard mentions one of the complaints of the tiler. “They interfere with the work, the glue was not right,” he continues.

“We are not doing this for the first time. They always leave everything tidy,” he says about the tiler’s working method. “And if damage does occur, we will compensate it.”
