Nick Kyrgios hopes he will not be prosecuted for assault based on his mental health condition. His lawyer appeared at a hearing in Canberra on Tuesday, while Kyrgios remains in Japan for the Tokyo ATP tennis tournament.

Michael Kukulies-Smith, Kyrgios’ lawyer, has asked for a postponement to allow time to investigate the Australian tennis player’s mental condition.

At the beginning of this year, Kyrgios (27), the number 20 in the world, already confessed that he had battled depression in the past. “I felt like I couldn’t talk to or trust anyone,” he wrote on social media. “I’ve had moments where it seemed like the positive vibes would never materialize.”

Kyrgios was charged with assault by his ex-girlfriend in 2021.

,,The only thing I have in hand, I handle off the track. I’m doing everything I can and I’m here in Tokyo and just trying to play good tennis, keep up the momentum and just do my job. That’s it,” Kyrgios said in Tokyo earlier this week.

The case is expected to resume in February of next year.
