Napoli-Eintracht, the TAR suspends the ban on the sale of tickets to Germans

The Frankfurt club’s request on the travel ban in the Champions League has been accepted: now the “ball” at the Viminale, which will have to issue a new provision

The Campania Regional Administrative Court upheld Eintracht Frankfurt’s appeal, suspending the provision of the Ministry of the Interior which forbade the sale of tickets to fans residing in Germany. But this does not imply that the sale itself has been automatically reinstated: the administrative justice body refers to the executive body for a more in-depth evaluation.

The measure

“The application and, as a result, suspends the contested measures – reads the device signed by the president Maria Abbruzzese – in the part in which, in relation to the football match scheduled for 15 March 2023 between the formations of Naples and Eintracht , the “prohibition of the sale of coupons to residents of Germany” was ordered. But technically the joint discussion of the appeal is scheduled for April 4, that is, beyond the match scheduled for next Wednesday. This means that it will be up to the Interior Ministry to prepare any further provision. However, the Tar underlines that “the danger to public safety remains only generically envisaged, but in fact, in the absence of further predictive elements, it can be predicted for all sporting events of this kind”. In short, the ministry’s provision was deemed disproportionate “since it ends up marrying the “zero option” without considering the possibility of containing the feared risk with alternative and less invasive measures”. For Eintracht a political victory, almost unexpected, but which does not automatically mean that German fans can arrive in Naples. Now we are waiting for a signal to arrive from the Viminale that will serve above all to the blue club to understand whether or not it will have to put on sale the quota of 2700 tickets foreseen for visiting fans.
