Hermès had filed a lawsuit against Namilia for trademark infringement because of a reworked Hermès Birkin bag that was presented on the catwalk by the Berlin fashion label Namilia at Berlin Fashion Week in July.
The Frankfurt Regional Court has now rejected Hermès’ application for an interim injunction, citing the right to artistic freedom. The court’s reasoning was that these pieces were only show pieces and not intended for sale, as Namilia writes on Instagram.
However, the decision is not yet legally binding because Hermès can still take action against it within two weeks.
Specifically, it was about a corsage that was made from a Birkin bag and was presented at the fashion show for the “S/S24-In Loving Memory of My Sugar Daddy” collection at Berlin Fashion Week.
