The municipality of Coevorden will appeal against the judge’s ruling in the case concerning the home adaptation of Jessica Poel (49) from Dalen. The judge decided three weeks ago that the municipality must again make a decision about adapting her home.
Among other things, Poel’s social situation was not properly looked at. For example, there was insufficient evidence that alternative homes are cheaper and at least as good as Poel’s current home. The municipality was given six weeks to come to a more appropriate decision.
It is a long drawn-out case, the chronically ill Jessica Poel from Dalen versus the municipality of Coevorden. Since October 2019, Poel has been trying to adapt her home through the Social Support Act (WMO). That was rejected by the municipality because there were cheaper alternatives.
Today the council of the municipality of Coevorden has decided that it will appeal to the Central Appeals Board. The Commission considers it right that the primacy of moving has been applied and indicates that the WMO will become unenforceable if the rules are set aside. In addition, the municipality believes that the circumstances of the Dalense have been taken into account.
Three weeks ago, Poel announced that she hoped that she would come to an agreement with the municipality after the verdict. That is different now: “I am not surprised, but broken”, says Jessica Poel. “It’s going to take a while this way.”
