More nitrogen space for PAS detectors available | News item

The cabinet has decided to adjust the prioritization of targets in the nitrogen registration system and to give higher priority to the PAS notifiers. The new system also ensures that as little nitrogen space as possible remains unused.

The cabinet feels a heavy responsibility to solve the problem of PAS reporters – entrepreneurs who, in principle, find themselves without the necessary nature permit through no fault of their own – as quickly as possible. We are constantly looking at which decisions can contribute to this. The nitrogen registration system (SSRS) was previously intended to allocate space from the Subsidy Scheme for the Remediation of Pig Farms (Srv) to housing projects and several major road projects (MIRT). Space that was not needed for these purposes could be allocated to PAS reports. Those agreements of the previous cabinet are now being adjusted. PAS notifications can be the first to use the available space when the reprioritisation takes effect.

Because the housing task is undiminished and usually requires little space, it has been decided that space can also be reserved for the most concrete housing projects for which a permit application is submitted within a year. It is expected that this will involve a very limited amount of nitrogen space. After the PAS notifications and the most concrete housing projects, projects concerning renovation and safety with regard to national roads (just like housing projects and PAS notifications) can also use the remaining space.

Amendment

The new system will eventually make more room available for legalizing PAS notifications. The adjustment in prioritization also applies to the space from the purchase scheme Measure Targeted Purchase (MGA) that will be added to the SSRS. The adjustment requires an amendment to the Nature Conservation Regulations, so that the new prioritization can be applied in practice from the beginning of October 2023. The current prioritization within the SSRS will apply until October, and the SSRS will also be reopened with the current cabinet decision.

With this step, the cabinet is doing everything it can to ensure that more PAS notifications are legalized in the short term because more nitrogen space is available for this. The granting of permits, however, remains a local tailor-made approach, in which the state of nature must also be involved.
