A German motorist who was flashed while on his way to the hospital with his unconscious daughter was not only forced to take a fine pay, but initially also lost his driver’s license. After he appealed, he was allowed to keep his driver’s license.

The 2-year-old girl’s father had every reason to hurry. When his daughter suddenly collapsed and passed out at home, the man decided to put the girl in his car and drive to the hospital. On the way, he was flashed at 82 km/h in a place where the speed limit is 50 km/h.

Shortly afterwards, the man was stopped by a nondescript police car. The officers recognized the emergency and escorted the father to the hospital with flashing blue lights. Not much later, however, the man received a fine of 348.50 euros in the bus and he had to hand in his driver’s license for a month.

Man could have called an ambulance

The man objected and the case went to court in Siegen, Germany. There, however, only the fine was reduced to 260 euros, the driving ban was maintained. According to the court, the man could have simply called an ambulance instead of racing to the hospital.

Ultimately, the case ended up in the Hamm Higher Regional Court. There, the decision of the court of Siegen has now been partially quashed, reports Bild.de. The man can keep his driver’s license. He was relieved: “It was an emergency, I had no other choice,” he says.

Because the man from Kosovo has only been living in Germany for two years and speaks German poorly, he says he could not or dared not call an ambulance. The man needs his driver’s license for his job as a road builder. The daughter had a febrile seizure at the time of fainting and was released from the hospital two days later.

As in Germany, exceeding the speed limit can also be justified in individual cases in the Netherlands when there is a state of emergency.
