Man is buried under wall and dies, contractor still acquitted

A construction company from Geldrop is not guilty of the death of a man who ended up under a wall in Mierlo in 2016. The court in Den Bosch acquitted the company on appeal on Wednesday. The court thought otherwise and previously ruled that the contractor had to pay a fine of 20,000 euros.

The accident happened at the end of 2016 at a construction project in Mierlo. The contractor from Geldrop hired a company from Best to do demolition work on a new construction project.

Two workers were left alone when they demolished a back wall. While clearing the debris, an inner wall that had been attached to the rear wall fell and landed on one of the men.

The judge previously ruled that both the contractor and the demolition company were responsible for the man’s death. They could have known in advance that the inner wall would become unstable. Upstairs there was no supervision.

According to the court, sufficient attention was paid to safe working conditions. The company’s project plan stated that the executor, i.e. the demolition company, must ensure a safe workplace and that the ultimate responsibility also lies there. According to the court, an employer cannot be expected to continuously have a supervisor next to an experienced employee.
