A 36-year-old man will not be sentenced for stabbing the ex-boyfriend of his current girlfriend to death. The court finds that there is a case of emergency: he defended himself. The East Brabant court in Den Bosch previously sentenced him to eight years in prison.
In April last year, the man and his girlfriend went to her ex-boyfriend’s apartment in Eindhoven ‘to talk’. The victim waited for the suspect with a pistol and pepper spray. On the gallery of the victim’s porch, a struggle broke out between the two men, with the victim still holding the gun.
The 36-year-old man from Den Bosch did not dare to run for fear of getting a bullet in his back. He then pulled a knife from his jacket pocket and stabbed the victim in the heart. The man died on the spot.

The court stated that there was an emergency situation: after all, the victim pulled a gun and had a can of pepper spray in his hand. The only way the man claimed to be able to defend himself was by pulling the knife. The gun was later found to be fake.
The court does not think that the man can be blamed for wanting to harm the victim, even though the man went to the victim with a knife.

Now that the court rules that there is a case of emergency, the man will be released from all legal proceedings. This means that the court does charge him for the stabbing, but does not impose a penalty on him. This also lapses the almost 70,000 euros in compensation that the relatives had demanded.
