The committee comes to the following conclusions: “Important core dispute. Is that statement a cancellation yes or no? Conclusion: in the statement we do not see a clear and targeted outcome towards FC Volendam. It is a communication addressed to the outside world, not clearly a termination of the employment contract. There is no clear date when the gentlemen would stop working. We are going to stop, it says. Instead of, we say with immediate effect. That is not stated in it. As far as the committee is concerned, there is no clear notice of termination of employment.”
The committee believes: FC Volendam cannot rely on termination, because there should be an obligation to investigate towards Team Jonk. There has been a build-up of tension for months. The press release that came out was written from emotion. Emotion is logical, because Team Jonk sees that a board they have worked with for years is being sent away.
According to the committee, FC Volendam should have made inquiries. Instead of accepting it as seeing the statement as an immediate cancellation.
