Lesmes’ ultimatum, Feijóo’s excuse, by Verónica Fumanal

Opportunities in politics are like in life, trains that one can jump on or miss, and the renewal of the General Council of the Judiciary is a high-speed train for the leadership of Feijoo, which has to be boarded in march and without thinking much about the risk of derailment that comes from the extreme right. Feijóo can prevent a national embarrassment by preventing Lesmes from resigning, Feijóo can prevent the conservative members who dominate the government of the judges with more than 1000 expiration days, from incurring a pseudo rebellion by not complying with the renewal of the Constitutional Court to which they are obligated.

Those who advocate the depoliticization of justice say that the judges impart it without further ado. An argument as fallacious as any other. The courts interpret the laws to apply it to each case, each judge with their criteria, their background and their ideology. Even on seemingly non-controversial issues, two courts can deliver completely different rulings. Let alone when they are in the eye of the hurricane, as the superior courts of the Autonomous Communities were during the pandemic, with the same law, some allowed confinements and others did not… so let’s stop saying that justice must be depoliticized, because it would be as much as saying that politics must be depoliticized or by refusing to renew the TC they are not doing politics.

During Pablo Casado’s brief tenure in the main opposition party, almost as many excuses were issued as there were members in the leadership for not reaching an effective agreement with the government. That if they had to kick Podemos out of the Government, that if the pact with Bildu made it impossible, that if the appointment of Dolores Delgado as Attorney General of the State blew up the bridges, that if Judge De Prada was the insurmountable stumbling block, that if the pardons, that if a new law for judges to elect judges… Meanwhile, the conservative majority of the Council remained placidly in power without any type of pressure being raised from the body to help unblock it. Also, it is very important to remember that all those excuses were just that, excuses, because PSOE and PP reached an agreement that Senator Cosidó blew up by sending a message to his colleagues in which he justified the agreement because they would control the second courtroom.

Feijóo is in a period of filming as a national leader and is still taking over the structure. He is normal, he has just come to the leadership of his party after an organic crisis that makes history. Therefore, his main objective is to send a clear message to the electorate that he is not married, a young man with no experience with more statements than management. Feijóo comes with his absolute majorities by flag and his institutionality without extravagance. Otherwise, an expired General Council of the Judiciary, with a conservative majority that no longer represents the correlation of political forces of the last elections, is willing to continue skipping the government’s deadlines to renew the Constitutional Court, a body that has pending pronouncements as important as Zapatero’s abortion law, the euthanasia law, the Celáa law or the reform that prevents appointments to the Judiciary. The quality of Spanish democracy depends on each of the institutions that make up the state; compliance with the laws, so many times repeated for the Catalan issue, seems not to work for those who should be scrupulous in complying with the laws, parties and judges, even if they don’t like them. Feijóo can show that his fame as a statesman really corresponds to the facts by complying with the Constitution and Lesmes’s anger, he should not miss this opportunity.
