A father who resides in Palma will stop paying the pension who has been paying her 28-year-old daughter for years, because the young woman has already managed to finish her university education and is in a position to enter the labor market. Her pension has been abolished by a magistrate of the Audiencia de Palma, who in her sentence “advises” the young woman to find work in order to become financially independent from his father with whom, by the way, he doesn’t even see him, he hardly speaks to him. The magistrate understands that the young woman, who studies at an important British university, “is in perfect condition to workIn fact, he has been doing sporadic work and with his training it will not be difficult for him to find work suitable for it or of any type, ”says the sentence.
The magistrate, citing the legal articles, recalls that children of legal age have the right to be supported by their parents. It is the parents who have to worry about sustenance, housing, medical care, clothing and education. This obligation is maintained until the child stops living in the family home and has their own resources to support themselves.
However, the duty to finance the academic training of a son “does not last indefinitely not until the children achieve economic independence. Parents have to pay for their children’s studies up to “the time normally required to complete the training”.
The parents of this young university student separated almost 20 years ago. It was an amicable divorce. The children stayed to live with the mother, but the father promised to pay support for his two children.
When the daughter reached the age of majority, her child support stopped passing through the hands of her mother, but the parent paid it directly into the young woman’s account.
The daughter decided to develop her university studies in England. She has successfully completed her training and it has been her teachers who have proposed that she start her doctorate, which can last between three and four years.
The father considered that the time had come that her daughter supported herself and in fact alleged that the young woman no longer lived in her mother’s home and had odd jobs. Her mother positioned herself in favor of her daughter, stating that the money she earns when she works is not enough to support herself and in fact, she and her current husband are in charge of helping her.
Without the court questioning these personal circumstances, it considers that the time has come for the father to stop paying for his daughter’s studies, because he is about to turn 30 and she is more than capable of finding work and supporting herself on her salary.
