The possibilities for overtime for staff with a permanent contract will be expanded. This leads to lower costs for employers. This is stated in a bill that went into internet consultation today. The proposal is part of the labor market package presented in April.

Due to the premium differentiation in the WW, employers pay a lower premium for permanent contracts and a higher WW premium for flexible contracts.

The adjustment has consequences for the so-called review situation that focuses on overtime. This applies if an employer pays the low unemployment insurance premium for an employee and then it turns out that that employee has an average of more than 30 percent overtime in a calendar year. In such cases, the employer must retroactively pay the higher premium.

At present, employees with contracts averaging 35 hours per week or more are exempt from the review situation. Soon all contracts with an average of more than 30 hours per week will also fall under this exception.

Internet consultation
The Ministry of Social Affairs and Employment will take the responses to the internet consultation into account when adjusting the decision. This process is recorded in a report. The amended decision will then be published on internetconsultatie.nl.
