Internet consultation on bill for a better functioning data economy started | News item

The use of digital data is indispensable in the economy and society. Cross-border regulations that ensure better distribution of the great value of data are therefore essential for companies and consumers. The EU Data Act is an important step to make the data economy as a whole work better. As of today, Minister Micky Adriaansens (Economic Affairs and Climate) is consulting on the draft Dutch implementing legislation for the Data Act. This will apply from September 2025.

The Data Act will ensure that you have more control over your data throughout the EU so that you can use this data in the way you want. For example, rules will be introduced in the EU about who has access to and use data from smart devices. This gives consumers and companies more control. They can also more easily switch between cloud services and connect services from different cloud providers.

Minister Micky Adriaansens (EZK): “These regulations will soon make it possible for consumers and companies to gain access to the data created by their use of digitally connected devices. This includes cars, household appliances and industrial machines. This is often still reserved for manufacturers and service providers. So you cannot have your own data or share it at your own discretion. I want to make that possible, as well as sufficient competition between companies and more room for innovation. A well-functioning and fair data economy is not possible without new standards.”

Rules for sharing data

The EU Data Act also lays down the rules for sharing data. Such as reasonable compensation to companies for making data available, good dispute resolution and tackling any unfair contract conditions.

Via the internet consultation companies, organizations and consumers can respond to the proposal for the Data Regulation Implementation Act, which, among other things, appoints supervisors and determines sanctions. After the internet consultation, the implementing law will be sent to the Council of State for advice and will then be discussed in the House of Representatives and the Senate.
