In the coalition agreement ‘Looking at each other, looking ahead to the future’, the private member’s bill for the introduction of a minimum hourly wage from the PvdA and GroenLinks has been embraced. The minimum wage is currently set on a monthly basis. As a result, an employee who works 40 hours a week has a lower minimum hourly wage than someone who works 36 hours a week. With the amendment of the law, the minimum hourly wage will be the same, regardless of the length of the working week. For minimum wage earners with a working week longer than 36 hours, the private member’s bill means an improvement in their income.

The government aims to introduce the statutory minimum hourly wage as of 1 January 2024.

The private member’s bill of PvdA and GL makes a number of changes to the Minimum Wage and Minimum Holiday Allowance Act (Wml). For example, Article 8 of the Wml includes a minimum hourly wage, the minimum daily and weekly wages are deleted and the minimum monthly wage only continues to exist as a reference monthly wage for the implementation of social security legislation.

Subordinate legislation – which refers to the current version of Article 8 – will also be amended to align with the new version of Article 8. This concerns seventeen general administrative orders (order in council) and nine ministerial regulations from various ministries in which technical changes are made. are being implemented. To this end, the Ministry of Social Affairs and Employment has drawn up a draft amendment decision and draft amendment regulation.

Anyone who wishes to can respond to the content of these draft regulations in the coming weeks (until 28 July 2022).
