The internet consultation on the General Administrative Order (AMvB) on the bill ‘supervision of equal opportunities in recruitment and selection’ started today. The aim of this bill is to combat labor market discrimination and to give everyone equal opportunities in finding a job. Employers and intermediaries are therefore required to have a working method in which they indicate how they structure their recruitment and selection process and ensure that labor market discrimination cannot play a role.

Employers with more than 25 employees must put the working method in writing. In addition, intermediaries are obliged to report discriminatory requests from clients to the Dutch Labor Inspectorate. If a client does not want to adjust this request after consultation. The Dutch Labor Inspectorate monitors this legislation.

The requirements of the law, including the requirements of the working method, are therefore further laid down in further rules: the Order in Council. This Order in Council is now open for internet consultation. Among other things, the Order in Council specifies the requirements that the recruitment and selection procedure must meet.

For example, it is stipulated that employers must pay attention to combating labor market discrimination in their working method. They must also include the procedure(s) for the recruitment and selection of personnel in their working method and the way in which they ensure equal opportunities. For example, job requirements should be relevant to the position and not unnecessarily exclude candidates.

The Order in Council leaves room for employers to set up the recruitment and selection process. For example, the Order in Council leaves room for various forms of recruitment and selection procedures and interventions that fit the practice of companies and organizations. The Order in Council also describes which steps intermediaries must follow if they suspect a discriminatory request by clients. This may result in a report to the Dutch Labor Inspectorate.
