Innovations & laws: This will change from March 2022

New notice period for consumer contracts is one month

Facility-based compulsory vaccination comes with limitations

Trees and shrubs may no longer be cut between March and September

New notice period for consumers

From March 2022, the notice period for fixed-term contracts will change, this is reported by the NDR guide. In the general terms and conditions of fixed-term contracts, a period of notice of three months to the end of the contract term was previously regulated. The contract period was otherwise extended by one year. From March 1, 2022, a notice period of one month will apply. If the deadline is not met, the term is extended indefinitely. Consumers can then cancel at any time with a notice period of one month.

Institution-related compulsory vaccination from March 16th

From March 16th, the institution-related vaccination obligation will officially come into force. Until an official decision is made, unvaccinated people should continue to be allowed to work in hospitals and care facilities. The health authorities therefore decide on how to proceed at their discretion. The unvaccinated status does not therefore necessarily lead to a ban on working.

Advice on organ donation and closed season for hedges and trees

When it comes to organ donation, the federal government is relying on more information services. From March 1, 2022, those interested in applying for an organ donor card should be able to receive educational material and organ donor cards from the authorities as well as information about other advice options from their family doctor. This is provided for in the updated Transplantation Act. According to the National Association of Statutory Health Insurance Physicians (KBV), general practitioners will receive a starter pack with the necessary information at the beginning of February. According to the decision of the Extended Evaluation Committee, doctors receive 7.32 euros for the consultation.

In addition, as of March 1, the “Act to Strengthen the Willingness to Make Decisions in Organ Donation” comes into force. This law is also intended to form the basis for an organ donation register that can be used to document people’s willingness to donate.

The new feature in the Federal Nature Conservation Act is also important for gardening enthusiasts. Cutting hedges and trees for no reason will be prohibited from March 2022. The 39 BNatSchG determines a so-called closed season during which the plantings may not be cut. This lasts from March to the end of September. Trees and shrubs provide habitat for many wild animals and plants that should not be destroyed. A breach of the law is considered an administrative offense that can be punished with a fine of up to 10,000 euros. Cropping may still be permitted under certain conditions.
