Hertha should take over the emergency presidium

It’s getting crazier at Hertha BSC!

For Hertha’s general meeting on Sunday (11 a.m.), one member has submitted motions to vote out the entire Executive Committee and Supervisory Board boss Klaus Brüggemann.

This Hertha member is apparently fighting on all fronts!

BZ learned: After the man (since March 14, 2022 a member of Hertha) had been rejected by Hertha’s association court with his applications for the removal from office of all members of the presidium, he even turned on the district court of Charlottenburg as the next step.

The madness: Here he submitted an application for the appointment of an emergency presidium!

The Crazy: This usually only happens in cases where the association bodies are unable to act. But at Hertha all committee members are still in office…

BZ is now the decision of the District Court of Charlottenburg (Department 95): The application of the Hertha member is rejected!

The decision states: For the district court, “the prerequisites for the appointment of an emergency presidium … do not exist. The Presidium consists of seven elected members and is capable of acting.”

It goes on to say, “the view of the association court…is followed.”

The association court had previously dismissed the Hertha member’s motions for removal from office against the members of the Presidium and declared their election to be effective but incomplete (because the election on June 26, 2022 was prematurely terminated after the number of Presidium members had reached seven, although according to Hertha’s statutes there were nine people would have been required).

The judgment also shows that the association court even reprimanded the applicant for misconduct. And soon even a club exclusion procedure could follow…

The reason for this are many problematic allegations, such as alleged “networking” of former Hertha investor Lars Windhorst with the Jewish community in London and a reference to the Jewish ancestry of new Hertha investor Joshua Wander, as well as possibly false accusations.

Among other things, the indirect allegation that the boss of the supervisory board, Brüggemann, could have waved through compensation for members of the executive committee could have legal repercussions for the Hertha member.

Brüggemann in the “Kicker”: “I reserve the right to take criminal and civil action against the applicant. Criticism is possible and desired at any time. But here someone is being deliberately discredited on the basis of false claims. The fact is that all members of the executive committee and supervisory board are paid zero expense allowances or other remuneration!”
