The delegation and the reference principles
The Government is delegated to adopt, within 20 months from the date of entry into force of the law, one or more legislative decrees for the revision and reorganization of the provisions in force on the subject of disability. The reorganization operation must take into consideration the provisions of the United Nations Convention on the Rights of Persons with Disabilities (with the optional Protocol for the appeal in case of violation of the rights established by the Convention itself) ratified in 2009, the Strategy for the rights of persons with disabilities 2021-2030 of the European Commission of 3 March 2021, and the resolution on the protection of persons with disabilities adopted by the European Parliament on 7 October 2021.
The areas of intervention
The legislative decrees will be issued on the proposal of the President of the Council of Ministers or of the Delegated Political Authority in the field of disability, in agreement with the Minister of Labor and Social Policies, with the Minister of Economy and Finance and with the Minister of health and other ministers who may be competent in the matters covered by the measures. These measures will intervene, progressively and within the limits of the resources available, in some areas. Among these, the definition of disability conditions, revision, reorganization and simplification of sector regulations. But also the assessment of the condition of disability and the revision of its basic evaluation processes. The National Disability Supervisor
Among the solutions envisaged by the delegation bill is also the institution of a national disability guarantor. A body that must have an independent and collegial nature. Among the functions it will have to perform, that of collecting reports from people with disabilities who report discrimination or violations of their rights, transmitting an annual report on the activity carried out to the Parliament, to the President of the Council, or to the delegated political authority on the matter of disability.
